Welcome to The Wombat™. These Terms of Service ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Platform"). By using our Platform, you agree to be bound by these Terms.
1. About Us and Our Service
The Wombat™ is operated by SUG Labs International Ltd (thewombat.co | hi@thewombat.co). We are a home services marketplace that connects homeowners with qualified local tradespeople and service providers ("Suppliers") through our website, mobile applications, and related services.
Important: The Wombat™ is not a contractor, tradesperson, or service provider. We do not perform any home improvement work. We connect you with independent suppliers who provide quotes and services directly to you.
2. Using Our Service
2.1 Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be located in Australia
- Provide accurate and complete information
- Use the service for legitimate purposes only
2.2 Quote Requests
When you submit a quote request:
- Your information will be shared with up to three qualified suppliers in your area
- Suppliers may contact you by phone, email, or SMS to discuss your project
- You are under no obligation to accept any quote or hire any supplier
- The service is free for homeowners - you pay nothing to The Wombat™
2.3 Accuracy of Information
You agree to provide accurate, current, and complete information when using our services. Providing false or misleading information may result in termination of access to our platform.
2.4 Electronic Communications
By submitting a quote request or otherwise providing your contact details, you consent to receive communications from us, our related bodies corporate, group companies (including other entities within the SUG Labs International Ltd group), our suppliers, and our partners via email, SMS, and phone. These communications may include:
- Service-related messages (quote notifications, supplier introductions)
- Marketing and promotional content related to home improvement, renovation, energy, and related services
- Offers, tips, and information from our group companies and selected partners
You can opt out of marketing communications at any time by clicking "unsubscribe" or contacting us. Service-related messages necessary for our service are not affected by marketing opt-outs.
3. Our Limitations
The Wombat™ does not:
- Perform any construction, installation, or repair work
- Guarantee the quality, timeliness, or completion of supplier work
- Set or control pricing for supplier services
- Employ or supervise the suppliers in our network
- Provide warranties on work performed by suppliers
4. Supplier Relationships
Suppliers on our platform are independent businesses, not employees or agents of The Wombat™. When you engage a supplier:
- You enter into a direct contract with the supplier, not with us
- All negotiations, pricing, and terms are between you and the supplier
- Any disputes regarding work quality or payment are between you and the supplier
- We encourage you to verify supplier credentials, licences, and insurance
Recommendation
Always get quotes in writing, check supplier credentials, verify licences relevant to your state, and confirm adequate insurance coverage before work begins.
5. Intellectual Property
All content on The Wombat™ website, including text, graphics, logos, images, and software, is our property or licensed to us. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or branding without authorisation
- Scrape, crawl, or automatically collect data from our website
- Reverse engineer any aspect of our platform
6. User Conduct
When using our services, you agree not to:
- Provide false or misleading information
- Submit spam, fraudulent, or duplicate requests
- Harass, abuse, or threaten suppliers or staff
- Use our platform for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Interfere with the operation of our website
7. Australian Consumer Law
Your Consumer Rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes any consumer guarantees or other rights you may have under the Competition and Consumer Act 2010 (Cth) or similar state and territory laws.
For services provided directly by us (such as our website and matching service), you are entitled to:
- Services provided with due care and skill
- Services fit for the purpose we have represented
- Services provided within a reasonable time
For services provided by suppliers, your consumer rights apply to your contract with the supplier directly.
8. Disclaimers
8.1 Service Provided "As Is"
Our website and services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:
- The availability or reliability of our platform
- The accuracy of information provided on our website
- The quality of suppliers in our network
- The outcome of any project undertaken with a supplier
8.2 Cost Estimates
Cost guides and estimates on our website are for informational purposes only. Actual costs vary based on project specifics, location, materials, and supplier pricing. Always obtain written quotes from suppliers for accurate pricing.
9. Limitation of Liability
Subject to the Australian Consumer Law guarantees in Section 7, and to the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services
- We are not responsible for any loss, damage, or injury resulting from work performed by suppliers
- Our total liability to you for any claim is limited to the greater of: (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 AUD
- Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified
10. Indemnification
You agree to indemnify and hold harmless The Wombat™, its directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
11. Third-Party Links, Services and Finance
Our website may contain links to third-party websites and services, including supplier websites, government resources, and finance partners. We are not responsible for the content, privacy practices, or terms of these external sites.
We partner with third-party finance providers to offer finance and payment options for home improvement projects. When you submit a finance enquiry or indicate interest in finance on a quote request, your contact details and project information will be shared with our finance partner, who may contact you directly to discuss finance options. Any finance arrangement is between you and the finance provider, subject to their terms, conditions, and approval process. The Wombat™ does not provide financial advice, credit assessment, or guarantee finance approval.
12. Dispute Resolution
If you have a dispute with us, please email hi@thewombat.co first. We will respond within 7 days and work to resolve it within 30 days. If unresolved, either party may pursue mediation or legal proceedings under Section 15.
For disputes with suppliers, contact the supplier directly. We are not a party to your contract with the supplier.
13. Changes to Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
14. Termination
We reserve the right to suspend or terminate your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, suppliers, or our business.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of our services will be subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
16. Assignment and Transfer
We may assign, transfer, or sub-license our rights and obligations under these Terms to any third party, including but not limited to:
- Any related body corporate or group company within the SUG Labs International Ltd group
- Any successor, purchaser, or acquirer of all or substantially all of our business, assets, or shares (whether by sale, merger, acquisition, restructure, or otherwise)
In the event of such transfer, your information and any rights and obligations under these Terms will transfer to the new entity, and these Terms will continue to apply. The new entity will be bound by the same obligations to you under these Terms.
17. General
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Wombat™ regarding your use of our services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
